1845 E B Gould, Mayor 19 May 1845 To the Honorable the Mayor and Aldermen of the City of St. Augustine
Your Petitioner Respectfully showed that twice since your honorable boy has been at the head of the city affairs he has been called upon to do patrol duty and that having failed to perform the same he has been twice summoned before the Mayor's court and fined and that your petitions is now further informed that the collection of said fines is sought to be enforced by process against his person.
Your petitions would therefore beg to state that his failure to attend patrol has not arisen from any feeling of disrespect to your honorable body but from his belief that the office which he hold of inspector of the Customs exempted him from such duty which belief has been conformed by the conduct of your predecessors towards your petitions has ? his appointment he was never until the organization of the present board called upon to perform ? the same.
This petitioner has been the more inclined to avail himself of this exemptions from the sickness which has prevailed in his family for the last six months which must have prevented him from performing patrol in person and the belief which he entertained made him neglect to procure a substitute.
Your petitioners now prays therefore that the fines imposed on him may be remitted. and in consideration of the same although still truly and firmly believing himself exempt from any liability to perform patrol your petitions hereby promises and agrees to perform. Hereafter such duty either in person or substitute with the understanding however that should this question be tried and decided in favor of his exemption of the Honorable Judge of the Superior Court then your petitions should be discharged from his present promise and agreement.
And your petitioner will ever ? etc. Very respectfully Lyman Southweek

Patrol was all present last night Three men of color was taken up viz: Wm and Tonny Clark (two free men) and William belonging to Gen Hernandez. An assault was made on the patrol by a man named Friedman a soldier who attends to the US garden near Mr. Francis Andreu's house. Bob Bola seems was his accomplices because when Freedman came towards me I discovered Bola behind me in an attitude to strike, when they left us he joined the soldier in abusing and swearing in consequence of that languages together with the loud talking I judge they were disturbing the peace of the city.
